If reporters and editors followed these points, the judge said, they would enjoy a degree of protection from libel action, even if they could not prove factual allegations.

The court also strikes Power Ventures' affirmative defenses (of misuse and estoppel) as unsupported by "any factual allegations."

Among other things, a Notice to Appear contains a numbered list of factual allegations against the respondent.

"The indictment already sets forth detailed factual allegations concerning the transactions that led to the appointment of Mr. Seymour."
